2 - HOW DOES IT WORK?

If you opt for a Paid Service on YourPropertyDoctor.com, you will incur a fee. This fee is paid to the Lawyer and serves as compensation for their time spent providing you with services within a limited-scope Lawyer-client relationship. Additionally, a portion of the fee covers YourPropertyDoctor.com's technology maintenance and operational costs. The fee paid for paid services pertains only to the defined scope outlined for that specific booking. Following the consultation, you may or may not directly engage the Lawyer for further services. YourPropertyDoctor.com holds no direct or indirect responsibility for the consultation and assistance provided by the Lawyers. Once the fee is paid and your booking is confirmed, you will receive confirmation via email, SMS, and/or phone.

We do not endorse, solicit, or promote any individual listed on the website. YourPropertyDoctor.com shall not be liable to you or any other individual for any decision made or action taken in reliance on such information

3 - INDEPENDENCE OF LAWYERS

These third-party payment service providers may include banking institutions, credit card payment gateways, payment aggregators, cash on delivery or demand draft/pay order on delivery service providers, mobile payment service providers, or any other facility authorized by the Reserve Bank of India for payment collection, refunds, and remittances.

By using the services of YourPropertyDoctor.com, you affirm that the bank/debit/credit card details provided by you are correct and accurate. These details are entered directly by you on the webpage of the third-party payment service provider, and YourPropertyDoctor.com does not have access to your payment information.

YourPropertyDoctor.com cannot assist with stop payment requests for any payments scheduled using a Payment Account credit/debit card. In such instances, you must directly contact your credit/debit card company or bank without delay.

11 - PAYMENT, CANCELLATION & REFUND POLICY

Payment Policy: All fees for paid services at YourPropertyDoctor.com must be paid in full upfront before availing the services.

Cancellation Policy : If a paid consultation is cancelled before its conclusion due to any reason, notification must be sent to YourPropertyDoctor.com in writing via email at info@YourPropertyDoctor.com. Cancellation charges will apply from the date of email receipt and must be requested at least 24 hours before the final delivery or appointment time. Refunds, minus a nominal deduction (10%) for online payment processing, will be processed within 15 business days from the date of cancellation notification. The refund will be credited to the original bank or credit card account used for payment.

Refund Policy : If a consultation request is accepted but subsequently rejected or cancelled due to unforeseen circumstances, users will have the option to opt for another consultation request or receive a complete refund. Refunds will be credited to the user's account within 15 working days. In the event of accidental overcharging, refunds will be processed within 15 working days upon notification to YourPropertyDoctor.com. If the transaction amount is less than the actual fee amount, the outstanding amount will be debited from the user's payment account. Users must maintain unique Transaction ID numbers provided at the time of request for assistance. YourPropertyDoctor.com reserves the right to provide refunds only in accordance with the conditions outlined in the Refund Policy. Any refund claims must not exceed the amount paid by the user for availing the services. No refunds can be claimed for payments made directly to the Lawyer by the user.

Please note that a nominal deduction (10%) will be applied to all refunded amounts for online payment processing. Refunds will be processed directly to the bank or credit card account used for payment.

12 - SUSPENSION DUE TO NON-COMPLIANCE WITH AGREEMENT

YourPropertyDoctor.com strives to deliver exemplary services for your payments. However, we cannot be held liable and will void any service guarantee under the following circumstances:

1. Inaccurate details provided, including contact information (email and/or phone number), username, and Payment account information.

2. Transaction failure with your bank due to reasons such as insufficient funds, fraudulent access, or processing failure by our Affiliate merchants or your bank.

3. Unforeseen circumstances beyond our control, such as fire, flood, or external interference, preventing the transaction's proper execution.

4. Failure to respond to requests for additional information from Lawyers to facilitate a consultation. We will notify you via email, phone, SMS, or message in your YourPropertyDoctor.com account.

5. Breach of any Terms and Conditions outlined in this Agreement and/or the Terms and Conditions of using YourPropertyDoctor.com.

13 - DISCLAIMERS

You understand and agree that your use of the YourPropertyDoctor.com Services is entirely at your own risk, and you accept full responsibility for any associated risks. We want to highlight that we have no editorial control over the Content provided by third-party content providers or other users on YourPropertyDoctor.com. All information, products, or services offered on or through this Website are provided "as is," without any warranty of any kind, whether express or implied, to the fullest extent permitted by applicable law. 23 - ASSIGNMENT

These rules encompass advertising, client solicitation, unauthorized practice of your profession, and truthfulness. We are not responsible for ensuring your compliance with these rules.

Upon submitting a Free Question to YourPropertyDoctor.com, you acknowledge and accept that your question and any response provided by a Lawyer/Professional will be included in the YourPropertyDoctor.com public database and become the exclusive property of YourPropertyDoctor.com.

For all Free Questions and associated answers, you consent to YourPropertyDoctor.com owning all rights to the submitted content, including intellectual property and moral rights, without any compensation to you. YourPropertyDoctor.com retains the unrestricted right to utilize, modify, distribute, and display the submitted content globally, in whole or in part, through various forms of media or technology, both current and future, for the duration of any existing rights.

28 - NON-CIRCUMVENTION

All professionals registered on the LegalKart platform, including lawyers, legal consultants, chartered accountants, company secretaries, or any other relevant professional (referred to as 'Professional'), agree not to attempt to acquire contact details from clients or other lawyers using the LegalKart or LegalKart-Lawyer app (hereinafter referred to as the LegalKart App). They shall refrain from sharing any contact information, including phone numbers, email addresses, social media handles, or office addresses, with any client or lawyer contacted through the platform. All communication, financial transactions, and interactions between professionals and clients initiated through LegalKart must occur solely through the platform's integrated communication tools. This policy aims to uphold platform integrity, ensure the privacy and security of all parties involved, and comply with data protection laws and regulations. Any attempt to bypass the platform, whether directly or indirectly, is discouraged. LegalKart reserves the right to request details from platform users and may employ artificial intelligence tools to monitor non-compliance while maintaining platform confidentiality and respecting the privacy of legal professionals and clients, in accordance with LegalKart's Privacy Policy.

29 - EXCEPTIONS

This clause may only be waived if a separate agreement is executed between the legal professional, the client, and LegalKart. Approval of such an agreement rests solely with LegalKart and is subject to its discretion.

30 - OFF-BOARDING

Violation of this clause may result in the immediate suspension or termination of the professional's LegalKart account, with or without prior notice.

31 - REPORTING

Clients are urged to promptly report any solicitation for personal contact information from a legal professional to LegalKart. Similarly, legal professionals must report any unauthorized sharing of personal contact information by a client.

32 - ENTIRE AGREEMENT

These Terms & Conditions, along with the privacy policy, which is considered an integral part hereof and incorporated herein by reference, constitute the entire agreement between you and YourPropertyDoctor.com regarding the subject matter herein, superseding all previous oral or written communications, if any, concerning such subject matter.

The Terms & Conditions take effect upon your first use of the Website in any capacity. We reserve the right to terminate this agreement and the licenses granted herein without notice if you (or any authorized user of your account) fail to comply with these Terms and Conditions or the usage rules for the YourPropertyDoctor.com service as stipulated by YourPropertyDoctor.com from time to time. We may also cancel or suspend your registration for any other reason, including extended inactivity, with prior notification when feasible. Upon termination, you must delete all copies of YourPropertyDoctor.com materials in your possession and cease accessing or using the Website. We may also delete any information, files, or other content previously accessible to you. Despite User's registration with the National Do Not Call Registry (fully or partly blocked category under the National Customer Preference Register established under the Telecom Regulatory Authority of India), User hereby expresses interest and consents to receive communication (including commercial communication) related to YourPropertyDoctor.com. User confirms that such communication shall not be construed as Unsolicited Commercial Communication under TRAI guidelines and that User has specifically opted to receive such communication on the provided telephone number.
